Terms and Conditions of Use for Pivot Proof

NOTICE
These Terms and Conditions of Use are legally binding. By purchasing, accessing, or using Pivot Proof (“the Offering”), a digital product created and sold by Markowski Studio LLC (“Company,” “We,” “Us,” or “Our”), You (“You” or “Your”) agree to be bound by these Terms, along with Our Privacy Policy. If You do not agree, do not purchase, access, or use Pivot Proof.
GENERAL PROVISIONS

DIGITAL PRODUCT ACCESS + LICENSE
Pivot Proof is a self-paced digital product. Upon purchase, You are granted a limited, non-transferable, non-exclusive license for personal, non-commercial use only. You may not duplicate, share, or sell any part of this product or its materials.
You may not:
Share Your login or materials with others
Allow others to access the Offering through Your login
Use content from Pivot Proof in client work, trainings, or other offers
Turn the content into a new product, resource, or service
Use any part of the Offering in AI or machine learning technologies without written permission
Repackage, republish, or distribute any part of the Offering publicly or privately
We reserve the right to revoke access at any time if these Terms are violated.
DELIVERY + ACCESS
Upon purchase, You will receive access to the Offering via email. It is Your responsibility to check for access instructions, including in spam or promotions folders. If You do not receive access within 24 hours, email hello@morganmarkowski.com.
COURSE EXPIRATION
You will have access to the Offering for the lifetime of the product, defined as the duration during which Markowski Studio LLC continues to host and maintain Pivot Proof. We reserve the right to discontinue the Offering at any time.
CONTENT UPDATES
We reserve the right to update, edit, replace, or remove any lesson, module, feature, or component of Pivot Proof at any time for accuracy, clarity, relevance, or business reasons, without notice or obligation.
INTELLECTUAL PROPERTY
All content within Pivot Proof — including but not limited to audio, visuals, written guides, templates, frameworks, and terminology — is protected intellectual property owned by Markowski Studio LLC. Reuse or redistribution without written permission is strictly prohibited.
You may not use any portion of Pivot Proof to develop a competing or derivative product, course, program, or training — even with attribution or modification.
NON-COMMERCIAL USE
Pivot Proof is for personal and internal business development only. You may not use it in Your coaching, courses, consulting, trainings, workshops, or team training without express written permission.
TESTIMONIALS & FEEDBACK
If You submit feedback, testimonials, or results, You grant Us permission to use it for marketing and promotional purposes, including use on our website, sales pages, emails, or social media, unless You explicitly request otherwise in writing.
TECHNOLOGY & THIRD-PARTY PLATFORMS
We are not responsible for technical issues related to third-party platforms, such as Thrivecart, email delivery, or payment processors. If You experience technical problems, please contact support promptly.
REFUND POLICY
Due to the nature of digital products, no refunds will be issued once access is granted. Please make Your purchase carefully. You may request support at hello@morganmarkowski.com for any technical or access-related issues.
PAYMENT TERMS
If You choose a payment plan, You agree to complete all payments. Failed payments may result in revoked access and collection efforts. A late fee of 1.5% per day applies after 14 calendar days past due.
TERMINATION
We reserve the right to revoke access without notice if You violate these Terms. All outstanding balances become immediately due.
VIOLATIONS, FRAUD & LEGAL ENFORCEMENT
If You initiate a chargeback, fraudulently share, duplicate, or distribute Pivot Proof without purchase, or otherwise violate these Terms, We reserve the right to:
Immediately revoke Your access to Pivot Proof and any other products or services offered by Markowski Studio LLC
Report the incident to Your financial institution, payment processor, and/or relevant legal authorities
Pursue civil or criminal action against You for damages, including but not limited to lost revenue, legal fees, chargeback penalties, and collection costs
Seek injunctive relief, monetary damages, and all available remedies under Illinois law
You acknowledge that these actions constitute material violations of these Terms and agree that We may enforce this clause to the fullest extent permitted.
DISCLAIMERS
This product is educational in nature. We make no guarantees about Your results. Success depends on multiple personal and business factors outside Our control.
We do not offer medical, legal, financial, or other professional advice. You agree to use the Offering at Your own risk.
LIMITATION OF LIABILITY
To the fullest extent allowed by law, We disclaim all liability for any damages resulting from Your use of the Offering, including but not limited to loss of revenue, profits, or business.
ARTIFICIAL INTELLIGENCE USE
